Error Jmail not found [solved]

Hi,
Joomla 2.5.8
Custom template
latest Poca Download 1.3.9
I updated the software in the hope of fixing this error recieved any time I upload or download a file to and from the software.
I have two sites effected by this problem.
the error reads:
Fatal error: Class 'JMail' not found in /home/www/rebuild.chelsearotary.org.au/libraries/joomla/factory.php on line 770
I believe it woud be an easy fix but can not discover how to..
any help appreciated.
